Terms of Service

The agreement between you and RWX-TEK INC for use of Jettson.dev.

These Terms of Service (the "Terms") form a binding contract between you ("you", the "User") and RWX-TEK INC, a California corporation ("Jettson", "we", "us"), governing your use of jettson.dev, the Jettson APIs, SDKs, dashboards, and related services (collectively, the "Service").

By clicking "Create account," signing in, or using the Service in any way, you agree to these Terms, the Privacy Policy, the Acceptable Use Policy, and the other policies referenced below. If you do not agree, do not use the Service.

1. Agent autonomy — read this first

Jettson agents are autonomous AI systems. They may make decisions, take actions, generate content, install software, browse the web, and interact with third-party systems in ways you did not specifically intend or anticipate.

By using the Service, you accept full responsibility for: the tasks you assign to agents; the consequences of those agents' actions; supervision of agent output; and any harm those actions cause to you or third parties. Jettson is not liable for agent decisions, errors, hallucinations, unintended actions, third-party damages caused by agents you operate, or losses arising from your reliance on agent output. 2. Definitions

  • "Account" — your registered user account on the Service.
  • "Agent" — an autonomous AI process started by you through the Service, running inside its own Linux environment.
  • "Content" — prompts, instructions, data, files, and outputs you provide to or receive from the Service.
  • "Documentation" — the technical and product documentation published at jettson.dev/docs.
  • "Fees" — the amounts payable for paid plans, as listed at /pricing.
  • "Free Tier" — the no-cost plan described at /pricing.

3. Eligibility

You must be at least 18 years old and legally able to enter binding contracts in your jurisdiction. You must not be barred from using the Service under any law or sanction list applicable to you, RWX-TEK INC, or our infrastructure providers (including the U.S. Office of Foreign Assets Control). By signing up you represent that you meet these requirements.

4. Account and API keys

You are responsible for keeping your password and API keys confidential. You are responsible for every action taken under your Account or with your API keys, whether you authorized it or not. Notify us promptly at customertek@rwxtek.com if you suspect unauthorized use. We may suspend the Account or rotate keys if we detect compromise.

5. Service description and modifications

We provide the Service "as-is" and may add, change, deprecate, or remove features at any time. We will use reasonable efforts to give material advance notice of breaking changes via email or in-product banners, but we are not obligated to maintain any specific feature.

6. Fees and payment

Fees are listed at /pricing and may change with thirty (30) days' notice (see Subscription & Billing Terms). Paid plans renew automatically unless cancelled before the period ends. You authorize us and our payment processor Stripe, Inc. to charge your payment method on each renewal. You are responsible for any applicable taxes. Refunds are governed by the Refund Policy.

7. Free tier

The Free Tier is offered as a courtesy. It has no service level commitment, may be paused or rate-limited at our discretion, and may be removed or changed at any time. Anything you build on the Free Tier remains your responsibility.

8. Acceptable use

You agree to follow the Acceptable Use Policy, which is incorporated by reference. Violations are grounds for suspension or termination without refund.

9. Your content

You retain ownership of your prompts, files, and other Content you submit. You grant Jettson a worldwide, non-exclusive, royalty-free license to host, copy, transmit, display, and process your Content solely to operate, secure, and improve the Service. We do not use your Content to train base models without your explicit opt-in (see AI Use Policy). You represent that you have the right to submit the Content you submit and that doing so does not violate any law or third-party right.

10. Third-party services

The Service depends on third-party providers including Anthropic, OpenAI, Fly.io, Vercel, Firebase / Google Cloud, and Stripe. Their availability, accuracy, and conduct are outside our control. We are not liable for their failures, outages, errors, or breaches.

11. Our intellectual property

Jettson, the Jettson logo, the Service software, the runtime, the documentation, and the underlying infrastructure are owned by RWX-TEK INC and protected by U.S. and international IP law. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service in accordance with these Terms. Trademark use is governed by the Trademark Guidelines.

12. Confidentiality

If we share non-public information with you about unreleased features, pricing, or roadmap, you will treat it as confidential and not disclose it without our consent. The same obligation applies to us regarding non-public Content you provide.

13. Termination

You may terminate your Account at any time from the dashboard or by emailing customertek@rwxtek.com. We may terminate or suspend your Account at any time for violation of these Terms, the Acceptable Use Policy, suspected abuse, non-payment, or where required by law. On termination: your access ends; we will retain billing records as required by law; and we will delete other Account data on the schedule described in the Privacy Policy.

14. Suspension

We may suspend the Account, throttle the Service, or halt specific agents without notice if we believe: (a) you are violating these Terms or the AUP; (b) the Service or other users are at risk; (c) payment has failed; or (d) law enforcement or legal process requires it.

15. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTY ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, ACCURATE, OR SECURE, OR THAT AGENT OUTPUT IS RELIABLE FOR ANY SPECIFIC PURPOSE. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO THE FOREGOING MAY NOT APPLY TO YOU IN FULL.

16. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

(a) JETTSON WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST REVENUE, LOST DATA, LOSS OF GOODWILL, OR BUSINESS INTERRUPTION, EVEN IF ADVISED OF THE POSSIBILITY.

(b) JETTSON'S TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (i) ONE HUNDRED U.S. DOLLARS ($100) OR (ii) THE AMOUNTS YOU PAID JETTSON IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

(c) Nothing in these Terms limits liability for gross negligence, willful misconduct, fraud, or for any other liability that cannot be limited under California law.

17. Indemnification

You will defend, indemnify, and hold harmless Jettson, RWX-TEK INC, its officers, directors, employees, and agents from any claim, loss, liability, damage, or expense (including reasonable attorneys' fees) arising out of or related to: (a) your Content; (b) your use of the Service; (c) any action taken by an agent you operated; (d) your violation of these Terms or the AUP; (e) your violation of any law or third-party right; or (f) any dispute between you and a third party.

We will defend you against any third-party claim that the Service, as provided by us and used in accordance with these Terms, infringes a U.S. patent, copyright, or trademark, and will pay damages finally awarded against you. This defense is conditional on you notifying us promptly, giving us sole control of defense, and cooperating reasonably. Our total obligation under this paragraph is subject to the limitation in Section 16.

18. Governing law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

19. Dispute resolution; arbitration; class action waiver

Read this section carefully — it affects your legal rights.

(a) Informal resolution. Before filing any claim, you and Jettson agree to attempt good-faith resolution by sending written notice to the other party describing the dispute. You will send notice to customertek@rwxtek.com. The parties will then have thirty (30) days to attempt resolution.

(b) Binding arbitration. Any dispute not resolved informally will be resolved by binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules. The arbitration will be conducted in Los Angeles County, California, in English, by one arbitrator. The arbitrator's decision will be final and binding. Judgment on the award may be entered in any court of competent jurisdiction.

(c) Class action waiver. You and Jettson agree that disputes will be resolved on an individual basis only. You waive any right to participate in a class action, class arbitration, or representative proceeding. If a court finds this waiver unenforceable, the affected portion of the dispute may proceed in court, but the rest remains in arbitration.

(d) Small-claims carve-out. Either party may bring an individual action in small-claims court for disputes within that court's jurisdiction.

(e) Equitable relief. Either party may seek injunctive or equitable relief in court to protect intellectual property or confidential information without first proceeding to arbitration.

(f) Opt-out. You may opt out of arbitration by emailing customertek@rwxtek.com within thirty (30) days of first accepting these Terms with the subject line "Arbitration Opt-Out" and your Account email in the body.

20. Force majeure

Neither party is liable for delays or failures caused by events beyond reasonable control: acts of god, war, terrorism, riots, embargoes, government actions, labor disputes, pandemics, internet or power outages, or failures of third-party providers.

21. Changes to these Terms

We may change these Terms from time to time. Material changes will be announced by email to the Account email and posted at /terms with an updated "Last updated" date. Continued use of the Service after the effective date of changes constitutes acceptance. If you do not agree, you must stop using the Service.

22. Notices

Notices to you may be sent to your Account email or posted in-product. Notices to Jettson should be sent to customertek@rwxtek.com with a copy by mail to the business address listed at /legal-notices.

23. Assignment

You may not assign these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, reorganization, or sale of substantially all of our assets.

24. Export control

You will comply with U.S. export control laws and the laws of any other jurisdiction that apply. You will not export, re-export, or transfer the Service or any technical data to any country, person, or entity prohibited by U.S. law.

25. Government use

The Service is "commercial computer software" developed exclusively at private expense. Use, duplication, or disclosure by the U.S. Government is subject to FAR 12.212 and DFARS 227.7202.

26. Severability; entire agreement

If any provision of these Terms is held unenforceable, the remaining provisions will remain in full effect. These Terms, together with the policies they reference, constitute the entire agreement between you and Jettson regarding the Service and supersede any prior agreements on the same subject.
